A Sri Lankan caught filming up the skirts of a woman at London Bridge station was spared jail after his barrister blamed 'cultural differences.' (weds).
Indika Rajapaksha, 35, was spotted by plain clothed police officers 'paying close attention' to women as he hovered around the bottom of the escalators on June 3.
They saw him slip behind a woman in a summer dress as she stepped on the escalator and attempt to slide his mobile phone between her legs.
When he was stopped, he freely admitted he was out trying to film up women's skirts and told police he had spent the morning targeting shoppers in Bond Street.
He then confessed he did it for sexual kicks.
Rajapaksha admitted two counts of committing an act outraging public decency at Westminster Magistrates' Court on June 17.
Prosecutor Simma Khan said: 'It was his intent to go out that day and he was planning to film up women's skirts.
'He is a man who deliberately left his home to embark on this behaviour.
'The women he took the films of have not been located by the police and still have not been found.'
Rajapaksha was arrested and his handset seized. Analysts found a number of videos including two clips of footage taken up women's skirts.
Ms Khan added: 'He did it for his own sexual gratification – and he had done it before.'
Sunil Pankhania, for Rajapaksha, insisted his client did not set out to film women and claimed there must have been a misunderstanding when he was interviewed because there was no interpreter.
'He became aroused by a woman he thought was wearing no underwear and then continued to take photos and videos up skirts,' he said.
Mr Pankhania also described the cultural differences between men and women in India and Rajapaksha's native Sri Lanka 'going some way to explaining his behaviour'.
'We have listened very carefully to what has been said about you,' said Magistrate David Kennedy.
'What you have done is a serious matter. You have displayed entirely unacceptable behaviour which has caused great offence to people.
'We did look at the issue of whether this offence deserves a custodial sentence.
'However, it is serious enough to warrant a community order.
'We are going to impose a community order for a period of 12 months.'
Just before leaving the dock, Rajapashka asked Magistrate Kennedy if he was allowed to travel on the underground again now that the matter was resolved.
'You can travel on the underground but do not repeat what you have done already,' he answered.
Rajapaksha, of Allenby Road, Southall will also have to undertake a rehabilitation activity for 30 days, carry out 80 hours of unpaid work and pay £325 costs.
